Reforms are coming to the Restaurant Industry Award from 11 August 2021. Are you ready?

As part of ongoing efforts to help the restaurant & café industry recover from the devastating impact of the COVID-19 pandemic, Restaurant & Catering Australia (R&CA) has secured landmark changes to the Restaurant Industry Award (RIA) designed to provide more flexibility & simplicity to businesses and staff operating under that award. 

The changes, which have been agreed to by the Fair Work Commission, will be in place for a period of 12 months from the 11 August 2021 and are optional for businesses to adopt. Businesses can choose to adopt all, some or none of the measures depending on their individual business’s circumstances. 

The three changes to the award are:

  • The introduction of an ‘Exemption Rate’ for senior employees
  • A simplified classification system
  • The ability for employers to pay allowances via a set hourly rate rather than for each instance they are accrued

R&CA strongly recommends ensuring you seek proper advice and support before adopting any of the proposed changes into your business. 

Errors in applying or implementing these changes could lead to Fair Work Ombudsman action or the termination of these agreement in the Fair Work Commission.
